Top 5 Worst Speeding Ticket Defenses

Comments Off

Everybody gets speeding tickets. It’s inevitable. No one goes exactly at or under the speed limit. It’s just too difficult. And while we’re speeding around we never think about it. Until we get that ticket and see the large amount of money the state or the city wants out of us as punishment. Then we think we can beat it.

I’m going to let you in on a secret. It’s possible to get a speeding ticket dismissed. I do it all the time. I’m a Seattle traffic attorney. Most of my time is devoted to helping people just like you wriggle out of those annoying speeding tickets. I win, though, because I know what works. Here are some examples of what doesn’t work.

First, the speed limit is illegal. This is a true defense I heard, and I actually had it heard today. Somebody got the idea in their head that if they could show the court that the speed limit was calculated incorrectly that the judge would be forced to dismiss the case. That idea was wrong.

Going with the flow of traffic. This is obviously a classic. Either some judge felt bad for someone on a particular day and dismissed a ticket for this or the idea just caught on for some strange reason. Take this one to court. The judge will listen like they care, then find you were speeding.

Avoiding some impending disaster. While this one actually makes sense in some respects, it usually falls on deaf ears. Whether it was the two semi-trucks that were about to sandwich you or a the swerving driver in front of you, this one’s usually a loser. Be prepared to answer the question, “why didn’t you slow down?”

The cop made a mistake. How hard do you think it is to point a gun at a car and shoot it? That’s what cops do with radar guns. And they do it all day every day. They rarely, if ever, get cars confused. And judges hear this one all day. And it doesn’t work.

There was no way I was speeding. I never speed. Problem with this one is that you’ve got a cop who says you were speeding. You are the one facing the fine, the cop probably doesn’t know you from Adam. Who do you think the court’s going to believe?

You can beat your speeding ticket. To do so all you need is a sound argument. Attack the speed measuring device, procedural errors, or factual errors. Do what traffic attorneys do.
